## The problem

Almost everything sold carries a legal guarantee longer than the shop admits, and most refusals at the counter are wrong.

## Who to claim from

- The seller — the shop or website you paid. The legal guarantee is theirs, even if they tell you to contact the maker.
- The maker, through its own warranty — useful once the legal guarantee has ended, or if the seller has closed.
- A private seller usually gives no legal guarantee. You can still act if the item was misdescribed or had a defect they hid.

## What they must do

1. First, repair or replace it — for free, within a reasonable time, without major inconvenience to you.
2. If that fails, takes too long or isn't possible: a price reduction, or your money back.

## Guarantees, country by country

### European Union

- Every seller must give at least 2 years of legal guarantee from delivery — repair, replacement, price cut or refund.
- During the first year a fault is assumed to have been there from the start (some countries give 2 years).
- For goods bought from 31 July 2026, choosing a repair extends the guarantee by at least 12 months.
- Makers of phones, tablets, washing machines, dishwashers, fridges, vacuum cleaners and screens must also offer repairs after the guarantee, at a reasonable price.
- For used goods, the seller can agree a shorter guarantee, but not under 1 year.

### FR

- New goods: 2 years, and for all 2 years the fault is assumed to have been there from the start. Used goods: that assumption lasts 12 months.
- A repair under the legal guarantee extends it (by 6 months for goods bought before 31 July 2026). If you asked for a repair and the seller replaced it, a new 2-year guarantee starts.
- Separately, hidden defects can be claimed within 2 years of discovering them.

### DE

- 2 years of statutory warranty (Gewährleistung); for the first 12 months the fault is assumed to have been there from the start.
- A seller can shorten it to 1 year for used goods.
- From 31 July 2026, choosing a repair extends the warranty once by 12 months.

### GB

- Within 30 days you can reject faulty goods for a full refund.
- Within 6 months a fault is assumed to have been there from the start; the seller gets one chance to repair or replace, then you can ask for a refund.
- After 6 months you may need to show the fault was there at delivery. You can claim for up to 6 years (5 in Scotland).

### US

- No fixed national guarantee: your rights come from the written warranty and from state law.
- A seller that gives a written warranty cannot disclaim the implied warranty that the product works as it should (Magnuson-Moss Warranty Act).
- "As is" sales can exclude implied warranties in many states. New cars are covered by state lemon laws.

### CA

- Provincial laws apply: goods must be of acceptable quality and fit for their purpose.
- In Quebec, goods must last a reasonable time for their price and normal use (the legal warranty), whatever the store's warranty says.

### AU

- Consumer guarantees have no fixed end: goods must last a reasonable time for what they are and what they cost.
- A major failure lets you choose a refund or a replacement; a minor one lets the seller repair it first.
- These rights apply on top of any maker's warranty and can't be excluded.

### PH

- New products carry an implied warranty that can't be excluded — at least 60 days and up to 1 year, or as long as a written warranty given with it.
- "No return, no exchange" signs don't apply to faulty goods.
- Under a written warranty, repairs are due within 30 days; if repeated repairs fail, you can ask for a refund or replacement.
- New cars: the Lemon Law covers 12 months or 20,000 km, whichever comes first.
- From a private seller: hidden defects can be claimed within 6 months of delivery (Civil Code).

## Do this, in this order

1. Find the receipt, invoice or order email — it proves the date.
2. Stop using it if that could make things worse, and take photos or a video of the fault.
3. Write to the seller (the letter below does it) and ask for a repair or replacement.
4. Keep every reply. If they refuse, go to the consumer authority or ombudsman below.
